Wikipedia embroiled in legal dispute in India, challenges to freedom of information

The dispute was filed in July by India's largest news agency, Asia News International (ANI), which accused Wikipedia of describing it as a "mouthpiece" of the ruling Bharatiya Janata Party (BJP) on its entry page, which was considered to have damaged its reputation. The case not only put Wikipedia's free editing model under legal scrutiny, but also raised concerns about whether reliable online information can be freely accessed in India.


Over the past few months, the case has gradually escalated, and at a hearing in the Delhi High Court on October 28, the court required the Wikimedia Foundation to disclose the identity of the user who edited the ANI entry, involving approximately $237,000 in defamation compensation. If Wikipedia refused to provide it, the court had warned that it would face the risk of being banned from operating in India, a move that sparked widespread discussion.


Wikipedia and the "chilling effect" of editing


Under pressure from the Delhi High Court, Wikipedia deleted the page about ANI, but the decision sparked widespread discussion, especially on the boundary between protecting free speech and power interference. Digital rights activist Nikhil Pahwa warned that the case could set an unfavorable precedent. If ANI wins, Wikipedia editors will be vulnerable to defamation lawsuits for the content of their entries, especially when it involves politicians or powerful public figures, which will directly affect Wikipedia's editing freedom. He pointed out: "This move may have a deterrent effect on people who edit Wikipedia entries, especially when it involves influential people, and may trigger a chilling effect on editors."


In the lawsuit, ANI also accused Wikipedia of spreading "false information" and demanded the removal of its introduction to news agencies. In response, Wikimedia argued that all content is edited by volunteers based on existing information, and its platform only provides publishing space, and the openness of content is the core feature of Wikipedia. However, on October 25, the court considered Wikipedia's open editing function "too dangerous" and believed that the way "anyone can edit content" lacked control.


Wikipedia censorship and litigation internationally


Wikipedia has long adhered to the principle of open editing and claims that its content is strictly verified by volunteers to ensure the accuracy of the information. However, many countries around the world have doubts about the openness of Wikipedia and have even taken bans and censorship measures. In 2015, China blocked the Chinese version of Wikipedia, and four years later, all language versions were banned. Last year, Pakistan once blocked Wikipedia for so-called "blasphemous content". Although access was restored three days later, the move still triggered reflections on information censorship. A Russian court also imposed a huge fine on Wikipedia in 2023 for not removing "banned content" about the Ukrainian war.


The world has different attitudes towards Wikipedia. Some countries restrict its access, while in other countries, Wikipedia is widely welcomed as an information resource. The open editing and multilingual support it provides are considered powerful tools, especially in the fields of academia and research. For example, New Delhi lawyer Ujjaini Chatterji pointed out that Wikipedia is "a great starting point for research" that not only provides information but also provides rich footnotes and links to facilitate the search for more resources. She believes that as a free source of information, Wikipedia provides a convenient basic reference for students and professionals in India.


A new test of information freedom and platform openness


India is the fifth country in the world in terms of the number of Wikipedia users, with more than 750 million visits per month and support for 23 Indian languages. For the general public in India, Wikipedia is an important channel for obtaining information from many aspects. If Wikipedia is restricted, India will have to face a key question: how to balance the free access to information with the controllability of content?
